Is freedom of speech under attack?

By now, we've all heard about the assassination of author and media personality Charlie Kirk. His murder took place on the campus of Utah Valley University while he was speaking on his "American Comeback" tour back on September 10, 2025.

Utah Governor Spencer Cox said that there were messages engraved on each of the four shell casings that law enforcement recovered at the scene. The most notable of which read, “Hey fascist! Catch! ↑ → ↓↓↓.” The shell casings and other evidence suggest the suspect, 22-year-old Tyler Robinson, was motivated by the belief that Kirk's commentary was sympathetic to fascist ideology.

Kirk was a vocal Trump supporter as well. Pundits of Kirk, including President Trump, condemned the act. Critics of Kirk had labeled him as far-right and racist. This could be due to his association with Turning Point USA’s then-national field director, Crystal Clanton, who was exposed for texting, “I hate black people. … End of story.” Click Here.

Charlie Kirk was the founder and CEO of Turning Point USA, a nonprofit organization that advocates conservative politics, among other things. Some may have assumed that Clanton's outlook permeated throughout the organization despite her swift dismissal after her texts were made public.

Kirk made some statements of his own that provoked controversy by denying the existence of systemic racism, calling George Floyd a "scumbag," and describing critical race theory as dangerous indoctrination. Kirk also called Dr. Martin Luther King, Jr. "awful."  In the wake of his death, people are now seeking to punish anyone who expresses a critical opinion of Mr. Kirk... Click Here.

Some have found the celebratory tone of social media posts offensive, especially as Mrs. Kirk is coping with losing her husband and father of her children. Several posts to online platforms about Kirk have been distasteful and insensitive to some of his fans, and now people are even being fired from their jobs for what they said on social media. Most famously, Jimmy Kimmel's show was suspended by ABC indefinitely after he made some remarks about Kirk.

Former President Obama chimed in on the Jimmy Kimmel situation, saying that the suspension of Jimmy Kimmel's show amounts to government coercion and also saying that the First Amendment to the Constitution was designed to prevent exactly that. Kirk was a proponent of free speech during his lifetime, and now, following his death, there has been a crackdown on certain speech. In the United States of America, we are free to say what we want, sometimes. While free speech is a cornerstone of the Constitution, it is not absolute.
